The main difference between Chapter 7 and Chapter 13 is that in Chapter 7 you discharge most or all of your unsecured debt and either agree to continue to pay secured debts or return the secured property (think house or car) and in Chapter 13 you devise a three to five-year repayment plan
where you pay all or part of your debt, the sum of which is decided based on a variety of factors.

Deciding which chapter to file under requires as much careful consideration as does just deciding to file. In some cases, you pay less in a Chapter 13 repayment plan than you would in a Chapter 7, but not all bankruptcy lawyers have the experience they need to determine which is best for you.
